Booking & Payment

Our prices are in €EURO, and are displayed on our web site. Payments made to us either by credit/debit card or by bank – bank transfer directly into our bank account MUST be made in €EURO.

We require a 50% deposit upon booking with balance payment to be received in cleared funds no later than 21 days prior to the event date itself. If a booking is first made after or within a 30 day period of an event date, then we require full payment. Booking and Payment can only be made in €Euro. Payment methods can be either with a credit /debit card via our web site or by direct bank-bank transfer into our bank account, details of which can be found on the dates and also the contacts page of our web site.

There shall be no formal and binding contract between Track2Test Limited and you until the requested deposit (or the full amount) has been paid.

We reserve the right to cancel or refuse any bookings at our sole discretion.

Payments made with credit card are subject to an additional surcharge fee of 2% of the amount paid. (This surcharge does not apply to debit cards)

Cancellation Policy

Due to the nature of the way in which Track2Test Limited must commit way in advance to the venues we provide, then it is necessary for us to operate a strict cancellation policy.

You may cancel your booking with us at any time prior to the commencement of the Event by giving us advanced written notice to either mark@track2test.com or stuart@track2test.com.

Track2Test Limited reserve the right to cancel an event at any time up to 10 days prior to the event date itself.

Cancellation Notice

Cancellation Notice and Refunds will be given on the following basis:

Cancellation of an event by Track2Test Limited at any time prior to an event will result in a FULL refund being given.

Weather & Track Conditions

Track2Test Limited cannot be held responsible for the impending weather conditions, outside temperatures and consequent track conditions as a direct result of such weather. No refunds will be given based upon participant’s disappointment of the weather conditions that may occur and affect on track conditions up to, prior and during a particular event, such as rain, high winds, snow, ice etc.

Force Majeure

In the event of a force majeure situation where the circuit is unable provide the facility for use to Track2Test Limited and its clients/participants, then in such circumstances Track2Test Limited will endeavour to transfer the event to an alternative date.

Risks Associated with the Event

Motor Sport is dangerous. You acknowledge and realise that your participation in the Event is potentially dangerous and that there are numerous risks associated with it. Such risks dangers include but are not limited to, collisions with spectators, vehicles, other drivers and/or fixed or moving objects and the negligence of other drivers. Further, you fully understand and realise that your participation in the Event may result in serious bodily injury and/or death to yourself or others.

With the full knowledge and understanding of the potential risks referred to above and associated with your participation in the Event, you enter the Event voluntarily and fully accept and assume every such risk for loss, damage or injury (including death).

Waiver of Liability

You fully understand that you have relinquished significant rights by doing so. You have done this at your own free will and without any coercion or duress from any third party. You fully intend your waiver to be a complete and unconditional release of such liability to the extent permissible by law and agree that if any aspect of this waiver is held to be invalid, then the remainder of this clause and these terms and conditions generally shall continue in full force and effect.

Indemnity

You hereby agree to fully release and unequivocally indemnify the Circuit and Track2Test Limited, our employees, consultants, agents, sponsors, licensees and assigns from all and any claims, demands, damages, liabilities or legal action arising directly from your negligence, error or omission at any Event whether made or claimed before, during or after the Event and which shall include all associated reasonable costs and expenses.

You further agree to reimburse us for all and any reasonable costs or fees incurred to us as a result of any damage caused by you or any persons forming part of your group to the infrastructure of the circuit, equipment and track itself during your attendance and/or participation in a Track2Test Limited event. You acknowledge however that such charges will only be payable to us where the circuit concerned has demanded payment from us. In such circumstances, it is preferential that participants settle directly with the circuit or us prior to their departure of the event.

General

Unless we have first agreed in writing, we are not bound by any variation to these terms and conditions.

You agree and accept all of these terms and conditions and understand that whilst we will use our reasonable efforts to ensure that all other participants at the Event abide by these terms and conditions, we cannot guarantee that these terms and conditions will at all times be complied with nor be held responsible or liable in anyway for their non-compliance.

You agree that by completing the booking form and accepting these terms and conditions you are entering into a legally binding agreement with Track2Test Ltd to participate in the Event on our terms and conditions.

You declare that all the information supplied by you on the booking form is to the best of your knowledge and belief correct and that you have read and understood the terms and conditions and agree to all of them (including but not limited to those relating to waiver of liability and indemnity) in full.

You further understand that whilst we will make every effort to ensure that your personal information is kept private, we shall not be held responsible nor liable should any information be lost or stolen by any third party.
